1. Acceptance of Terms

By accessing or using Explore Whangārei (the "Website") at explorewhangarei.co.nz, or by purchasing any service from us, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use the Website or our services.

2. Changes to These Terms

We may update these Terms from time to time. The current version will always be posted on this page with the "Last updated" date. Your continued use of the Website or services after any change means you accept the updated Terms.

3. Our Services

Explore Whangārei is an online local directory. We offer businesses:

4. Building and Approving Your Listing

4.1. We prepare and build your listing, featured placement and any articles for you, using information you give us together with information from public sources such as your own website and public business profiles. We take care to get the details right.

4.2. We give you the opportunity to review what we have produced before or shortly after it goes live. You are responsible for checking your listing and telling us of anything that is wrong or needs changing, and we will make those changes for you. Once you have approved your listing, or once it has been live for a reasonable time without you raising any issues, it is treated as accurate and accepted by you.

4.3. You are responsible for the accuracy of the information you supply to us, and for letting us know when your details change so we can keep your listing up to date.

4.4. By providing content (including text, images, offers and article details), or by approving content we prepare for you, you grant us a non-exclusive, royalty-free licence to use, edit, format, publish and display it on the Website in connection with your listing.

4.5. Content must not be false, misleading, unlawful, offensive, or infringe the rights of others. We may edit, decline or remove content at our discretion.

4.6. Some services are managed through a private link we provide, rather than a password account. Please keep that link confidential.

5. Pricing and Payments

5.1. Currency and tax. All prices are in New Zealand Dollars (NZD). We are not currently registered for GST, so no GST is added to our prices.

5.2. How you pay. Depending on the arrangement, you can pay by credit or debit card, processed securely by our payment provider Stripe, or by an invoice we send you, which can be paid by bank transfer or card. We do not store your full card details. The available payment method will be made clear at the time of purchase.

5.3. Subscriptions. Directory listings and featured placements are annual services that continue year to year unless cancelled, so your listing stays live without interruption. If you pay by card, your subscription renews automatically each year. If you pay by invoice, we send you a renewal invoice each year.

5.4. One-off purchases. Guest articles are one-time purchases and are not subscriptions.

5.5. Cancellation. You can cancel a subscription at any time by contacting us at admin@explorewhangarei.co.nz. When you cancel, your service continues until the end of the paid (or invoiced) period and then will not renew, and you will not be charged or invoiced again. We do not provide partial refunds for the remaining period.

5.6. No refunds. Except where required by the Consumer Guarantees Act 1993 or other applicable law, payments for our services are non-refundable.

5.7. Price changes. We may change our prices at any time. Price changes do not affect the current paid period of an active subscription but may apply to renewals and new purchases.

5.8. Billing questions. If you think there is an error with a charge, contact us at admin@explorewhangarei.co.nz within 30 days and we will review it in good faith and work to resolve it promptly.

6. Intellectual Property

The Website and its original content, features and design are owned by Explore Whangārei and are protected by copyright, trademark and other laws. You may not copy, reproduce or reuse them without our permission, except for your own content, which remains yours.

7. Acceptable Use

You agree not to use the Website to break the law, infringe others' rights, transmit harmful code, attempt to gain unauthorised access, or interfere with the operation of the Website.

8. Third-Party Links and Reviews

The Website may show links to third-party websites and live business reviews from third-party services. We are not responsible for the content, accuracy or practices of those third parties.

9. Disclaimer and Limitation of Liability

9.1. The Website and services are provided on an "as is" and "as available" basis. To the extent permitted by law, we make no warranties that the Website will be uninterrupted, error-free or free of harmful components.

9.2. To the maximum extent permitted by law, Explore Whangārei is not liable for any indirect, incidental, special or consequential loss arising from your use of, or inability to use, the Website or services. Nothing in these Terms limits rights you have under the Consumer Guarantees Act 1993 or other law that cannot be excluded.

9.3. Website content. The Website includes general information about local places, businesses, events and activities. Some of this is drawn from public sources or third parties, and some is compiled or updated automatically. While we take care to keep it accurate, details such as opening hours, prices, availability and event times change often. We do not warrant that all content is accurate, complete or current, and you should confirm details directly with the relevant business or organiser before relying on them.

9.4. Listings and reviews. Business listings, ratings and reviews shown on the Website may come from the businesses themselves or from third-party services such as Google, and do not represent our endorsement.

10. Termination

We may suspend or remove a listing or account, with or without notice, if you breach these Terms, if content is unlawful or harmful, or if a payment is not made. Where you have paid for a current period and we end the service for reasons other than your breach, we will refund the unused portion.

11. Governing Law and Disputes

These Terms are governed by the laws of New Zealand. Any dispute will first be addressed through good-faith discussion, and if not resolved, through mediation or the New Zealand courts.
